1. Agreement to Terms
By creating a Kizuki account, you ("Merchant") agree to these Terms of Service ("Terms"). If you don't agree, don't sign up.
2. Service Description
Kizuki is a B2B SaaS that monitors public social media posts matching merchant-supplied keywords, generates AI-drafted reply candidates, and delivers them via web inbox + Telegram bot. The merchant (or their authorized team) ultimately clicks "Send" on the platform itself.
3. Subscription Plans
- Demo — Free, 5 drafts/month, no credit card
- Pro — $50/month pre-tax, 400 drafts/month hard cap
- Business — $200/month pre-tax, 2,700 drafts/month hard cap
- Enterprise — $500/month + $500 one-time setup + ~$700 Mac mini hardware bundle; 7,000 drafts/month + edge fleet onboarding
4. Hard cap, NOT overage
Each plan has a fixed monthly draft cap. Once reached, Kizuki pauses new draft generation until cap resets at UTC 00:00 on the 1st of next month. You are never charged more than your plan's monthly fee.
5. AI Disclosure
Replies are drafted by AI (Anthropic / Google / OpenAI, routed by cost). You may edit drafts before sending. We disclose AI involvement transparently in merchant UI (confidence stars, model used, cost per call).
5.1 AI hallucination + accuracy disclaimer (L-2)
AI-generated text may contain factual errors, fabricated prices, fabricated dates, or fabricated product details. Kizuki provides suggested drafts ONLY; the merchant is responsible for reviewing every draft for accuracy before sending. Default reply rules require human approval for complaints, refunds, and competitor mentions. Auto-send (where enabled) operates within the merchant's configured confidence threshold and reply rules; the merchant retains full responsibility for content sent under their identity.
Kizuki is not liable for downstream consequences of inaccurate AI output that the merchant or their agent approved for sending, including but not limited to: refund disputes, customer complaints, platform terms-of-service violations, regulatory issues (advertising / pharma / financial claims), or reputational harm.
6. Liability
Kizuki is provided "AS-IS" without warranty. Aggregate liability for any claim is capped at 3 months of your most recent subscription payment. We are not liable for platform bans, lost sales, or AI translation errors causing miscommunication.
7. Cancellation
Account moves to "cancelled" status; data retained 90 days then permanently deleted. Monthly fees are non-refundable except where required by law (EU 14-day cooling off / similar).
